Chapter 7: | For debtors with relatively little assets, other than residence or vehicles with small amounts of equity. Completing a Chapter 7 proceeding results in a complete discharge (wiping out) of unsecured debts, with exceptions for most state and federal taxes, educational loans, child support and certain other debts. |
Chapter 13: | For debtors who are behind in mortgages, or who have assets which would have been distributed to creditors in a Chapter 7 bankruptcy. Chapter 13 cases require debtors to make regular payments to a trustee for at least 3 years. |
